Sister-in-laws ex-husband is taking her back to court to try and get custody of kids.
He is an ass.
He has connections in town and county where divorce was finalized.

Can my sis-in-law get a change of venue for this adjustment?

She went to a lawyer on a friday, paid her $1500 for something on a monday. Then a couple days later the lawyer came back and said she had a conflict.
Sis-im-law needs to get it into another county.

The only thing I can recall from studying for the Bar last year had to do with conflicts between different states - Parent X is in Missouri, Parent Y files in Indiana for custody-type situations. In this case, Missouri is the child's home state and will retain jurisdiction even if she tries to leave the state in order to get away from the original jurisdiction (generally speaking).

Regarding changes of venue in state, (a) the criteria varies by state, but (b) I'm not sure the typical civil procedure venue rules apply to family court situations. Not my area, so I can't say. I tend to doubt it, though.

I seem to recall there being a family lawyer here. Hopefully they'll check in at some point. This isn't really my area, it's late, and I'm hopped up on Clutch right now.
